    Appellant

    On May 19, 2021, the federal district court for the District of Delaware scheduled oral arguments on the motion to remand the case. The court allocated 75 minutes to each side. The defendants filed a notice of supplemental authority to remind the court of the recent decision by the Second Circuit to dismiss a similar climate change case brought by the City of New York against fossil fuel companies.

    Delaware’s claims included negligence, trespass, and nuisance. It also sought compensatory damages, penalties for violating the Consumer Fraud Act, attorneys’ fees, and costs of suit.

    Appellant’s specific questions

    The Delaware Supreme Court will determine the standard of proof in this case, and will address the remaining questions in the context of the new statute. The case will also consider whether there are sufficient importers in Delaware to serve all of the retail licensees. This will determine whether the state has enough jurisdiction to protect the welfare of the children in the Appellant’s case.

    The Appellant’s premises are located 75 yards south of Delaware City limits. It is adjacent to the Town of Delaware City and the Delaware City-Port Penn Road, which is the primary north-south highway through Delaware City.

    Commission’s decision in denying applications

    The Delaware City Commission denied the applications in part and found them legally valid, but they denied the Negroes of the Delaware City community equal protection of the law in other ways. The Appellant’s claim of discrimination is not based on race, but rather on the fact that he wants to buy alcoholic liquors in the same way as the White citizens of Delaware City.

    The Commission has a formal procedure to investigate complaints filed in the public interest. If the Commission is notified of a formal complaint, it must serve a notice to the public that the matter is being investigated. It may also give the public an opportunity to comment on the matter.
